Privacy policy

This policy describes how Ultimate Boating collects and processes the personal data of its users, in compliance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and the amended Law No. 78-17 of 6 January 1978, known as the "Informatique et Libertés" Act.

Data controller

The data controller is Sébastien Sauteraud, sole trader (entrepreneur individuel, EI) trading under the name "RDI", established in Romans-sur-Isère (26) (SIREN 801 105 180). No data protection officer (DPO) has been appointed to date; for any question relating to your data, you may write to [email protected].

The website is open to the general public and entirely free of charge: it requires no account, no registration and no payment. No account, billing or payment data is collected. The Service is funded through affiliate links.

Data collected

Depending on how you use the Service, the following data may be collected:

  • When the map of marine professionals is published, data from the professional listings: company name, contact details and description of the establishment. This is public business information, collected and published by the publisher. This section is not open to the public at this date.
  • Audience measurement and browsing data: pages viewed, connection data and technical information (IP address, device and browser type).

Purposes and legal bases

  • Determining the visitor's country from their IP address, in order to route affiliate links to the corresponding store: legitimate interest (Article 6.1.f GDPR). This data is neither stored nor cross-referenced with other information.
  • Publishing the directory of marine professionals on the map, when that section is open to the public: legitimate interest (Article 6.1.f GDPR).
  • Audience measurement and improvement of the Service: legitimate interest (Article 6.1.f), by means of a cookie-free, anonymised solution.
  • Response to contact and support requests: legitimate interest of the data controller (Article 6.1.f).
  • Compliance with legal obligations: legal obligation (Article 6.1.c).

Recipients and processors

The data is intended for the authorised departments of the data controller. It may be disclosed to processors acting on its behalf, within the meaning of Article 28 GDPR:

  • the website host: IONOS SARL (7 place de la Gare, 57200 Sarreguemines, France);
  • audience measurement: Matomo, self-hosted by the publisher on its own server (stats.ultimate-boating.com), with no transmission to a third party;

Each processor provides sufficient guarantees as to the implementation of appropriate technical and organisational measures. The data is neither sold nor rented to third parties. In addition, Cloudflare, Inc. (San Francisco, United States), the delivery and security network through which every request to the website passes, receives your IP address on that basis, for security and performance purposes and to determine your country so that affiliate links can be routed accordingly. When the map of marine professionals and the marina pages are published, the display of the map tiles (CARTO) and of the marine weather (Open-Meteo) further relies on direct calls from your browser to these services, which then receive your IP address for strictly technical purposes; the weather coordinates queried are those of the displayed marina, never those of the visitor.

Transfers outside the European Union

Audience measurement (Matomo) is self-hosted in France and involves no transfer outside the European Union. The website uses no third-party authentication, payment or storage service. All of the website's traffic does, however, pass through Cloudflare, Inc., a company established in the United States: this transfer of your IP address is governed by the standard contractual clauses adopted by the European Commission, incorporated into Cloudflare's data processing agreement. When the map of marine professionals and the marina pages are published, two technical services are moreover called directly by your browser, which therefore transmits your IP address to them: the CARTO map tiles (a company established in the United States), on the Map page only, and the Open-Meteo marine weather, on marina pages. This loading, strictly necessary for the requested display, is based on the publisher's legitimate interest (Article 6.1.f GDPR); in the case of CARTO, it may involve a transfer of your IP address outside the European Union. Affiliate links point to third-party websites (notably Amazon and Click&Boat), which apply their own privacy policies once you choose to follow them.

Retention periods

  • Contact requests: three (3) years from the last contact.
  • Audience-measurement data: as Matomo is configured without cookies and with IP-address anonymisation, no directly identifying data is processed; raw visit data is deleted automatically after twenty-five (25) months, in accordance with the CNIL's recommendations, and only aggregated, anonymous statistics are kept beyond that.

Your rights

In accordance with the applicable regulations, you have the right to access, rectify, erase, restrict the processing of, object to and port your data, as well as the right to set out directives concerning what happens to it after your death.

You may exercise these rights by sending your request to [email protected], or by post to the publisher's registered address. Proof of identity may be requested in the event of reasonable doubt as to the identity of the applicant. A response will be provided within one month, which may be extended under the conditions provided for by the GDPR.

Cookies and trackers

The website places no tracking cookies and uses no advertising trackers. Audience measurement relies on Matomo, configured in “cookie-free” mode, with IP-address anonymisation and respect for the “Do Not Track” and “Global Privacy Control” signals: to object to this measurement, you simply need to enable one of these signals in your browser settings. This mechanism, strictly anonymous and proportionate, falls under the consent exemption provided for by the CNIL's guidelines on audience measurement: no cookie banner is therefore required, and you have no action to take. In practice, the website only writes convenience information to your browser, likewise exempt from consent: a “ub_lang” cookie storing the language you have chosen (12 months), sent to the website with every request so that you are served the right language version; in local storage, your light or dark theme preference (“ub_theme”), the collapsed state of the menu (“ub_sidebar_collapsed”) and the draft of your project workshop (“ub_advisor_state_v3”, ignored and replaced after 30 days); in session storage, your comparison selections (keys beginning with “ub_”: engines, profile, propellers, systems), erased when the tab is closed. Information stored locally never leaves your browser and is not transmitted to any third party.

Certain pages contain affiliate links (identified by the rel="sponsored" attribute): if you make a purchase after following one of these links, the publisher may receive a commission, at no extra cost to you. As an Amazon Associate, the publisher earns from qualifying purchases. These links influence neither the characteristics displayed nor the comparator scores, which remain neutral and based solely on technical data.

Lodging a complaint with the CNIL
